The attorney-general of Osun state has filed a suit seeking a court order to compel the inspector-general of police (IGP) and the commissioner of police to investigate the death threat issued by Francis Fadahunsi, senator representing Osun east, against Accord members.
The suit was filed at the Osun high court in Osogbo on Wednesday.
Respondents in the suit are the IGP and Osun police commissioner, while Fadahunsi was listed as “person affected/interested party”.
BACKGROUND
Speaking during a recent political meeting, Fadahunsi instructed All Progressives Congress (APC) supporters to “kill” members of the rival Accord Party if seen during the electoral process in some parts of the state.
“From now on, whenever you see Accord members, kill them. I authorise you to kill them. They have wives and children too,” Fadahunsi had said.
Subsequently, the senator said his comment was metaphorical and meant that his supporters should defeat Accord at the ballot box through lawful and peaceful means.
In a letter dated August 11, 2026, the police invited the senator to “clarify the circumstances” surrounding the statements allegedly made during the APC campaign in Ilesa.
The senator honoured the invitation of the police and was later granted an administrative bail.
THE SUIT
According to a copy of the suit seen by TheCable, Oluwole Jimi-Bada, the Osun AG, asked the court to compel the police to “obtain, secure, preserve, authenticate, and forensically examine the complete and unedited version of the said video recording” made by the APC senator.
The Osun AG also sought an order compelling the police to protect members of the Accord party and other voters against any form of violence.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, whether by themselves, their officers, agents, commands, formations, or any authority under their command, to immediately and thoroughly investigate the video recording/publication circulating publicly and allegedly showing Senator Francis Adenigba Fadahunsi, Senator representing Osun East Senatorial District, making statements that constitute a clear and present danger of public incitement to violence, threats to life, threats to public peace, electoral violence, political intimidation, and threats to the free exercise of the electoral rights of citizens of Osun State, specifically calling for the killing of members and supporters of Accord Party and threatening to prevent duly registered voters from freely exercising their franchise in the forthcoming Osun State Governorship Election,” the suit reads.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately obtain, secure, preserve, authenticate, and forensically examine the complete and unedited version of the said video recording/publication and to meticulously investigate the circumstances surrounding its creation and dissemination, including but not limited to the location, date, audience, sponsors, publishers, circulators, and all persons connected with the statements allegedly contained therein, ensuring the integrity and chain of custody of all evidence.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately and comprehensively investigate the alleged statements credited to Senator Francis Adenigba Fadahunsi to the effect that members of the All Progressives Congress (APC) should kill Accord Party members anywhere they see them; kill their wives and children; chase them from hotels; and treat them as persons who are not normal human beings because they wear yellow caps, and to determine the full extent of their potential criminal implications under the Criminal Law of Osun State and other relevant statutes.
“AN ORDER OF MANDAMUS compelling the Respondents, jointly and severally, to immediately take all necessary lawful and preventive security measures to protect members, supporters, candidates, agents, and officials of Accord Party, as well as voters and other residents of Osun State who may reasonably be endangered or intimidated by the alleged incitement, threat, or public provocation arising from the said statements/publication, ensuring their safety and the peaceful exercise of their fundamental rights.”
